Eviction for rent arrears in Cambrils: practical steps for landlords

When payments cease, acting promptly helps limit the debt and preserve evidence. Changing locks, cutting utilities or entering without consent are not legal solutions and may exacerbate the conflict.
Documents to be gathered
Rental contract and annexes.
Bank statements and list of unpaid monthly payments.
Communications with the tenant.
Security deposit, inventory and proof of ownership.
Data on potential guarantors or sureties.
Requirement and pre-negotiation
The requirement must identify the contract, amounts, and payment or possession deadline. Since the entry into force of Organic Law 1/2025, many civil proceedings require proof of a prior attempt at negotiated resolution (MASC). The debt can continue to increase until possession is restored. After delivery or eviction, it is advisable to document the state of the property, damages, and utility readings. Execution for recovery of amounts due is a separate phase and will depend on the debtor's solvency.
